These Terms of Services govern your access to and use of the services and digital products provided by HITSOUND PRO. By accessing our website or using any of our services, digital products, or educational content, you agree to be bound by these Terms of Services. Hitsound Pro provides digital creative services and may also offer physical products, musical equipment, and related goods.
Services Description
HITSOUND PRO provides professional audio-related services, digital products, educational content, and lyric video services. These may include audio production, mixing, mastering, arrangement services, digital music resources, educational materials, and the creation of lyric videos for music releases.
User Responsibilities
You agree to provide accurate, complete, and up-to-date information when using our services, purchasing digital products, or accessing educational content. You are responsible for ensuring that any materials, files, or content you submit do not infringe upon the rights of any third party and comply with applicable laws. You agree not to use our services, products, or content for any unlawful or unauthorized purpose.
Content Restrictions / Acceptable Use
HITSOUND PRO reserves the right to refuse, suspend, or terminate any service request or collaboration that involves content which, at its sole discretion, is considered offensive, hateful, discriminatory, defamatory, sexually explicit, immoral, or harmful. This includes content that promotes hatred, violence, or disrespect toward religions, beliefs, individuals, or groups. HITSOUND PRO is not obligated to justify or disclose the reasons for refusing such requests and shall not be held liable for any consequences resulting from such refusal.
Service Delivery & Timeline
Service delivery timelines are provided on an estimated basis only and may vary depending on the scope of the project, the quality and completeness of materials provided by the client, and workload at the time of service. HITSOUND PRO shall not be held responsible for delays caused by incomplete information, late feedback, technical issues, or circumstances beyond its reasonable control.
Revisions and Feedback
Revisions are provided on a limited basis and are subject to the scope of the selected service or package. Any revision requests must be clearly communicated and submitted within a reasonable timeframe after delivery. Additional revisions beyond what is included in the selected service may be subject to additional fees. HITSOUND PRO reserves the right to determine whether a request constitutes a revision or a new request.
Payments
Payment terms may vary depending on the scope and value of the selected service or package. For certain services or higher-value projects, an upfront deposit may be required, with the remaining balance due before final delivery of the completed work, as agreed in writing. Any previews, drafts, or samples provided prior to full payment are for review purposes only and do not constitute final delivery. HITSOUND PRO reserves the right to withhold final files or completed deliverables until full payment has been received. Payments and refunds are governed by our Refund Policy, which forms an integral part of these Terms of Services.
Production Credits & Branding
All music production services are delivered under the Hitsound Pro brand.
Public-facing credits, branding, and presentation are handled exclusively by Hitsound Pro.
Termination of Services
HITSOUND PRO reserves the right to suspend or terminate any service, project, or access to services if the client violates these Terms of Services, fails to comply with agreed conditions, engages in abusive, threatening, or inappropriate behavior, or requests content that violates applicable laws or content restrictions. Where reasonably possible, HITSOUND PRO may notify the client and attempt to resolve the issue before terminating the service. However, immediate termination may occur in cases of serious breach or misconduct. In the event of termination due to the client’s breach, non-compliance, or misconduct, any payments made shall remain non-refundable, and HITSOUND PRO shall not be obligated to continue or complete the remaining services. Termination of services shall not affect any rights or obligations that by their nature are intended to survive termination.
Intellectual Property
Unless otherwise expressly agreed in writing, all intellectual property rights in the services, digital products, educational content, MIDI files, sessions, templates, arrangements, productions, recordings, and materials created or provided by HITSOUND PRO remain the exclusive property of HITSOUND PRO. No ownership rights are transferred to the client. Only usage rights are granted.
Educational content is licensed for personal learning purposes only and may not be shared, redistributed, resold, or used for commercial teaching or training. Producer tools and digital products may be used to create original works, including commercial productions, but may not be resold, shared, or redistributed as standalone or competing products.
Any arrangement or production created specifically as a paid custom service is licensed exclusively to the client for its intended use. Such exclusivity does not transfer ownership of intellectual property unless otherwise agreed in writing. Nothing in these Terms restricts the client’s rights as a performer, author, composer, or lyricist of their own original contributions. HITSOUND PRO does not claim entitlement to streaming revenue, publishing income, or distribution royalties unless explicitly agreed in writing under a separate agreement.
Covers and Third-Party Content
HITSOUND PRO may provide production, arrangement, audio processing, mixing, mastering, or lyric video services for cover songs or other content based on third-party works. HITSOUND PRO does not own and does not claim ownership of the original compositions, lyrics, melodies, or recordings of such works and does not grant licenses for their distribution or monetization. The client is solely responsible for obtaining any required licenses or permissions. HITSOUND PRO shall not be held responsible for copyright claims, takedowns, demonetization, or platform actions affecting such content.
Limitation of Liability
HITSOUND PRO provides professional creative and technical services but does not guarantee commercial results, platform approval, monetization, audience growth, or content visibility. Any liability, where applicable, shall be limited to the amount paid by the client for the specific service or product concerned.
Governing Law
These Terms of Services shall be governed by and interpreted in accordance with the applicable laws, without regard to conflict of law principles.
